Blackrock Casino AML / KYC Policy
This document sets out the Anti-Money Laundering (AML) and Know Your Customer (KYC) policy framework applied by Blackrock Casino in accordance with applicable legal obligations in South Africa. All users of the services of Blackrock Casino are subject to the procedures and requirements described below.
1. Legal Framework and Regulatory Basis
Blackrock Casino operates as an accountable institution under South African law. AML and KYC obligations are governed primarily by the Financial Intelligence Centre Act (FICA), No. 38 of 2001, as amended, and the Prevention of Organised Crime Act (POCA). These statutes require the implementation of customer due diligence, transaction monitoring, record-keeping, and suspicious activity reporting measures.
A written AML compliance program is maintained, a designated compliance officer is appointed, and periodic internal audits are conducted to ensure adherence to statutory requirements and relevant industry standards.
2. Customer Due Diligence and Identity Verification
2.1. Mandatory Identification
Before establishing a business relationship or processing any transaction, the identity of every customer must be verified. For this purpose, you are required to provide:
- Full legal name
- Date of birth
- Residential address
- Government-issued identification document (national identity card, passport, or driver’s licence)
- Proof of address (utility bill, bank statement, or official correspondence dated within the last three months)
The authenticity of submitted documents is verified through manual review and, where applicable, through electronic verification systems.
2.2. Beneficial Ownership and Legal Representatives
Where an account is opened on behalf of a legal entity or by a representative, the following information and documentation are required:
- Identification and verification of the beneficial owner(s) holding 25% or more of ownership or control
- Documentation establishing the legal structure and control of the entity
- Authorisation documents proving the representative’s authority to act on behalf of the customer
2.3. Enhanced Due Diligence
Enhanced due diligence measures are applied to customers identified as higher risk, including:
- Politically exposed persons (PEPs), their family members, and close associates
- Customers from jurisdictions identified as high-risk by the Financial Action Task Force (FATF) or South African authorities
- Customers whose transaction patterns or behaviour raise concerns
Enhanced due diligence may include additional documentation requests, source-of-funds verification, and senior management approval before account activation or transaction processing.
3. Purpose and Nature of Business Relationship
During the onboarding process, information is collected regarding the intended purpose and nature of your relationship with Blackrock Casino. This includes an understanding of your expected transaction volume, frequency, and the source of funds you intend to use.
You must provide accurate and complete information. Failure to do so may result in account suspension or termination.
4. Ongoing Monitoring and Transaction Surveillance
4.1. Risk-Based Monitoring
Customer accounts and transactions are monitored on an ongoing basis using a risk-based approach. The level and frequency of monitoring depend on the assessed risk profile of each customer.
Monitoring systems are designed to detect:
- Large or unusual cash transactions
- Rapid deposit and withdrawal cycles
- Transactions inconsistent with the customer’s known profile or stated purpose
- Structuring of transactions to avoid reporting thresholds
- Cross-border transfers to or from high-risk jurisdictions
4.2. Suspicious Activity Reporting
Where transactions or behaviour are identified that may indicate money laundering, terrorist financing, or other criminal activity, there is a legal obligation to report such activity to the Financial Intelligence Centre (FIC) without delay. Suspicious Activity Reports (SARs) or Suspicious Transaction Reports (STRs) are filed in accordance with FICA requirements.
You will not be notified if a report concerning your account is submitted to the FIC. Disclosure of such reporting is prohibited by law.
5. Record-Keeping
All records related to customer identification, verification, and transaction activity are retained for a minimum of five years from the date of the transaction or from the termination of the business relationship, whichever is later.
Records include:
- Copies of identification documents
- Verification results
- Account opening forms and correspondence
- Transaction records and monitoring logs
- Internal risk assessments and compliance notes
Certain records, including foreign exchange transactions, may be retained for up to ten years in accordance with South African Reserve Bank requirements.
6. Compliance Officer and Internal Controls
Blackrock Casino has appointed a designated AML compliance officer responsible for overseeing the implementation and effectiveness of this policy. The compliance officer ensures that:
- Staff receive regular AML and KYC training
- Internal procedures are updated in response to regulatory changes
- Independent testing and audits of the AML program are conducted periodically
- Communication with the FIC and other regulatory authorities is maintained
7. Customer Obligations
You are required to:
- Provide accurate, complete, and current information during account registration and verification
- Notify the platform promptly of any changes to your personal details, address, or identification documents
- Respond to requests for additional documentation or information within the timeframe specified
- Ensure that funds deposited into your account originate from legitimate sources
Failure to comply with these obligations may result in restrictions on your account, suspension of services, or account closure.
8. Consequences of Non-Compliance
Non-compliance with AML and KYC requirements may lead to:
- Refusal to open or activate an account
- Suspension or restriction of account functionality
- Withholding of withdrawals pending completion of verification
- Termination of the business relationship
- Reporting of suspicious activity to the FIC
The company reserves the right to refuse service to any individual or entity that does not meet applicable AML and KYC standards or that is assessed as posing an unacceptable risk.
9. Prohibited Relationships
Blackrock Casino does not establish or maintain business relationships with:
- Shell entities without legitimate business activity
- Individuals or entities on sanctions lists administered by the United Nations, the European Union, OFAC (United States), OFSI (United Kingdom), or South African authorities
- Customers who refuse to provide required identification or verification documents
- Customers who provide false, misleading, or fraudulent information
10. Updates and Amendments
This policy may be updated from time to time to reflect changes in applicable law, regulatory guidance, or internal risk assessments. Updates will be published on the official website. Continued use of the services following publication of an updated policy constitutes acceptance of the revised terms.
